Distribution of copies or phonorecords of a work to the public by sale or other transfer of ownership, or by rental, lease, or lending. The offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display, constitutes publication. A public performance or display of a work does not of itself constitute publication. 17 USC

The act by which a thing is made public and differing from promulgation.

Publication has different meanings. When applied to a law, it signifies the rendering public the existence of the law; when it relates to the opening the depositions taken in a case in chancery, it means that liberty is given to the officer in whose custody the depositions of witnesses in a cause are lodged, either by consent of parties, or by the rules or orders of the court, to show the depositions openly, and to give out copies of them. When it refers to a libel, it is its communication to a second or third person, or a greater number. And when spoken of a will, it signifies that the testator has done some act from which it can be concluded that he intended the instrument to operate as his will.

a patent application is published twice during the procedure:
  • a European patent application is published as soon as possible after the expiry of a period of eighteen months from the date of filing or, if priority has been claimed, as from the date of priority (Article 93, Rules 48-50 EPC);
  • at the same time as the Office publishes the mention of the grant of the European patent, the Office publishes a specification of the European patent containing the description, the claims and any drawings, Articles 98 and 103, Rule 53 EPC. An international patent application, where the Office is designated, is published under Article 21 PCT and is mentioned in the European Patent Bulletin (Article 158 EPC).

In publications on industrial property information matters, the terms "publication" and "published" are normally used in the sense of making available the contents of a document to the public.

Depending on the particular national law, patent documents may be published on several levels of publication, as detailed in WIPO Standard ST.16.

The international application or any related documents are not published prior to the expiration of 18 months from the priority date, unless the applicant requests early publication of the international application, or the application is withdrawn.

Publication
To publish is to make publicly known, and in reference to text and images, it can mean distributing paper copies to the public, or putting the content on a website.

The word publication means the act of publishing, and it also means any writing of which copies are published, and any website. Among publications are books, and periodicals, the latter including magazinesscholarly journals, and newspapers.

Computers and the internet have changed the face of publishing, lowering the cost, and allowing more people to publish, through both desktop publishing and internet publishing.
