A formal written accusation, drawn up and submitted under oath to agrand jury by the public prosecuting attorney, charging one or more personswith a crime. The grand jury must determine whether the accusation, if proved,would be sufficient for conviction of the accused, in which case the indictmentis indorsed by the foreman. Once an indictment is filed, the matter passes tothe Court. Indictments also serve to inform an accused of the offense withwhich he or she is charged and must be clear enough to enable the accused toprepare an adequate defense. Indictment
In the common law legal system, an indictment is a formal accusation of having committed a criminal offense. In those jurisdictions which retain the concept of a felony, the serious criminal offense would be a felony; those jurisdictions which have abolished the concept of a felony often substitute instead the concept of an indictable offence, i.e. an offence which requires an indictment.
